TERMS AND CONDITIONS - NATIONAL MASTER AUDITION ’23/Summer Intensives

1.     National Master Audition ’23 is organized by Ballet California and held at the Lauridsen Ballet Centre Premises and referred to in this Agreement as the “Organizer.”  The registered applicant (and their parent/legal representative) of the National Master Audition ’23 will be referred in this Agreement as the “Applicant.” 

2.     Registration for the National Master Audition ‘23 implies a full acceptance of the Terms & Conditions between the Organizer and the Applicant. This agreement is deemed read and accepted when the Applicant (or his/her legal representative) clicks on the button “Submit and proceed to payment” of the Online Application form related to the Terms & Conditions.

3.     Purpose: to provide the opportunity to pre-professional dancers ages 13-17 to audition in front of many ballet company Artistic Directors or their Representatives in view of obtaining an acceptance into a Summer Intensive Program.

 4.     Eligibility:  Applicants must be 13-17 years of age. Additional requirements for participating companies vary and can be found on their websites.

 5.     Registration: Submission instructions are on the website of Ballet California at www.balletcalifornia.org  Applicants must provide the requested documents (as listed below) in the correct format, and complete online payment via credit card by the Deadline of 5:00 pm, Pacific Standard Time, Thursday, December 21, 2023. 

 6.     Requested documents and Registration Fee to submit with online application:

·         Headshot with clear background. 

·         Dance Shot in Arabesque. Please submit photos as .JPG only. Minimum 800x800 pixels or 2 MB.

·          $100 Non-Refundable Registration Fee.

7.     Unpaid applications will not be accepted.

8.     Reimbursement/Cancellation: Any cancellation/withdrawal by Applicant before or during the National Master Audition ’23, for any reason, does not entitle the reimbursement of any fee. If Applicant decides not to attend/participate for any reason he/she is not eligible for the refund.

9.     If Organizer does not secure required number of applicants for the National Master Audition ’23 to take place, Organizer will refund registration fee, via a check mailed to the applicant’s mailing address on the application.

10.     Organizer reserves the right to close application process once the number of applicants reaches its limit. 

11.     Late Applications, if space provides, on a first come first serve basis, a late application may be accepted at an additional fee of $20.  

12.     Organizer, Applicants, and participants will follow all CDC health protocols at the time of the audition.

13.     Organizer does not provide travel, accommodations, food, nor any other supplies or amenities.

14.     Organizer will email to the applicant, schedule of audition at least one week prior to the Auditions.

15.     At the National Master Audition:  

·         Audition is Saturday, December 30, 2023.

·          Classes are closed to anyone not participating in the audition classes.  

16.     Dancers may only take the classes to which they are assigned. Classes are closed to viewing.

17.     All decisions by the Artistic Directors are final. Participation in the audition does not guarantee any acceptance into a program. Ballet California has no control over offers and no information about acceptances. Please wait to be contacted by individual companies.

18.     Organizer is not responsible nor liable for lost, damaged, or stolen property.

19.     It is the Applicant’s responsibility to review the information they enter and make sure all items are correct.  Organizer will only respond to an email entered by the Applicant on the online application form.  Ballet California is not responsible for the information entered in the Application.

20.     PHOTO RELEASE: For good and valuable consideration, the receipt of which is hereby acknowledged, I hereby grant Ballet California permission to use my likeness in a photograph or video in any and all of its publications, including but not limited to all of Ballet California's printed and digital publications. I understand and agree that any photograph or video using my likeness will become property of Ballet California and will not be returned. I acknowledge that since my participation with Ballet California is voluntary, I will receive no financial compensation. I hereby irrevocably authorize Ballet California to edit, alter, copy exhibit, publish, or distribute this photo or video for purposes of publicizing Ballet California's programs or for any other related, lawful purpose. In addition, I waive the right to inspect or approve the finished product, including written or electronic copy, wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photograph. I hereby hold harmless and release and forever discharge Ballet California from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.


Indemnification
Applicant or his/her parents/legal representatives hereby agrees to indemnify and hold harmless Ballet California, Laurisden Ballet Centre, and/or the agents, employees and directors of this institution (collectively, the “Indemnified Parties”) for any loss, claim, damage, suit, costs or expenses, including attorneys’ fees and court costs, resulting from or arising out of any injury to any person or damage to property, caused by the Applicant or whether caused in whole or in part by the negligence of the Indemnified Parties, incurred as a result of or during the National Master Audition ‘23 or any activities in connection with the National Master Audition ‘23.

Assumption of the Risk of Participation and Use of Lauridsen Ballet Centre premises: By signing this Agreement, Candidate or his/her parents/legal representatives agree to assume full responsibility for, and risk of, bodily injury, death, or lost or stolen or property damage to which relate to or arise out Applicant’s entry into or use of Ballet California and Lauridsen Ballet Centre Premises in any way. By signing this Agreement Applicant or his/her parents/legal representatives acknowledge that the risks associated with entry into and use of the Ballet California and Lauridsen Ballet Centre Premises may be both foreseen and unforeseen and may include serious physical injury and/or death, and other personal and property damages, and agree to assume all associated risks.

The Declaration

I declare that all the information that I have provided is complete and accurate and I am fit to participate in the event.

I, the undersigned, hereby declare that I know that I am about to participate in a Dance activity that demands significant physical effort.

I hereby declare that I am healthy and fit for the activity and have trained for it accordingly.

I understand that my participation in the National Master Audition ‘23 event, under the circumstances that I am not adequately in physical form, may endanger my health. 

I am aware that the organizing committee of the event, the hosting party, the organizers, the producers and/or the sponsors will not undertake any responsibility for any harm that I may endure, including bodily harm that may occur prior to the event, during or thereafter, nor are they responsible for any lost, stolen, or damaged belongings. 

I declare that if during the National Master Audition ‘23, I suffer or if I suspect that I suffer from any sickness, including fever, digestive issues or cough, then I will consult a physician prior to the event. I will participate only if cleared to do so by a physician. Dancers displaying symptoms may be asked to provide a doctor’s note in order to participate. 

BY PAYING THE APPLICATION FEE, APPLICANT HAS READ, UNDERSTOOD, AND AGREED TO THE TERMS & CONDITIONS IN THIS AGREEMENT.
